MN SKI HAWKS SPORTS & SOCIAL CLUB ACKNOWLEDGEMENT OF RISK, RELEASE, AND INDEMNIFICATION AGREEMENT

Please read and understand this document before indicating acceptance. If you have any questions, please ask us or consult with an attorney. By indicating acceptance, you are giving up specific legal rights for you, your family, and your heirs.

I understand that engaging in the sport of downhill skiing or any other activity (collectively “the activities”) organized by the MN Ski Hawks, Inc., also known as the SKI HAWKS SPORTS & SOCIAL CLUB, the MN SkiHawks and the SkiHawks, herein referred to as “SKI HAWKS” involves risk of serious injury, disability, and death. I understand, acknowledge, and am fully aware of these risks. I agree that all activities in which I participate are undertaken by me at my own risk. I also certify that I am fully capable of participating in the activities. The Conduct section of the SKI HAWKS SPORTS & SOCIAL CLUB By-Laws is available at www.mnSkiHawks.org. I have read the Conduct section of the SKI HAWKS SPORTS & SOCIAL CLUB By-Laws and agree to conduct myself in compliance therewith.

As consideration for being allowed to join the SKI HAWKS and to participate in its activities, I agree to, and do, waive any legal right to any claim for myself, my family, my heirs, executors, and assigns, for damages, losses, injuries, death, property damage, property loss, and expenses suffered or sustained by me in connection with these activities, or arising out of, or resulting from, my participation in these activities. This release of liability covers all risks of the activities, the transportation to and from an activity, and any negligence of SKI HAWKS, its agents, its officers, and its members. Nothing in this Acknowledgement of Risk, Release, and Indemnification Agreement shall be interpreted as me releasing SKI HAWKS, its agents, officers, and members from liability for injuries, damage, death, or other loss to me or others that may occur and is caused by SKI HAWKS’s, its agents’, its officers’, or its members’ gross negligence, recklessness, or intentional misconduct.

I agree not to sue SKI HAWKS, its agents, its officers, and its members for any actions, causes of action, past, present and future claims and damages, damages in law, and remedies in equity of whatever kind, including the negligence of SKI HAWKs, its agents, officers, and members, the negligence of another participant, and the negligence of myself, arising out of participation in the activities and the transportation to and from an activity.

I agree to indemnify and hold harmless SKI HAWKS, its agents, officers, and members, from all claims, damages, losses, injuries, death, property damage, property loss, and expenses suffered or sustained by me in connection with these activities, or arising out of, or resulting from, my participation in these activities including the transportation to and from an activity. I also agree to indemnify, to subrogate, and to reimburse SKI HAWKS its agents, officers, and members for any damages, costs, fees or expenses SKI HAWKS, its agents, officers, and members expend on my behalf, including the cost of any Search and Rescue, and for any damages I may do to third parties.

I hereby give permission for transportation of myself to any medical facility or hospital. I authorize any qualified person or medical personnel to render necessary emergency medical care for me. I hereby authorize the release of any medical information in the possession of Ski Hawks to any medical facility, hospital, ambulance, first aid provider, first aid service, doctor, nurse, or other such person rendering care on my behalf.
